Terms of Use

These terms govern your use of the Omeletter app and the website at omeletter.app, both published by Fisheggs Pty Ltd. By using either, you agree to them.

1. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use Omeletter for your own enjoyment. You may share your daily result, a link to a puzzle, or a screenshot.

2. What you may not do

Reproducing a single puzzle, with attribution to Omeletter, in a review or in teaching is fine and does not require our permission.

3. Ownership

The puzzles, clues, software, artwork, the name Omeletter and the names of the individual games are owned by Fisheggs Pty Ltd or used under licence. Nothing in these terms transfers any of that to you.

Omeletter is generated using our own software over publicly available wordlists and lexical databases. Where third-party data is used under licence, it is used within the terms of that licence and is not redistributed as part of the app.

4. Purchases

Access to the back archive is sold as an in-app purchase through the App Store. Apple handles the payment and the receipt. Purchases are tied to your Apple Account and can be restored on your other devices using Restore Purchases in Settings.

Refunds are handled by Apple, not by us, at reportaproblem.apple.com. Nothing in these terms limits any right you have to a remedy under the Australian Consumer Law, including for a major failure.

5. Availability

We aim to publish a new set of puzzles every day, but we do not promise uninterrupted availability. We may change, suspend or withdraw the app or the website, or any part of them, at any time.

6. Consumer guarantees and liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.

Subject to that, Omeletter is provided "as is". To the extent the law permits, we exclude all other warranties, and our liability for any claim arising out of your use of Omeletter is limited to resupplying the service or refunding what you paid for it. We are not liable for indirect or consequential loss.

7. Governing law

These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.

8. Changes to these terms

We may update these terms. The date at the top of this page shows when we last did. Continuing to use Omeletter after a change means you accept it.
